Legal Options for Veterans Exposed to Asbestos

JUNE 13, 2025 – Many veterans, especially those who served in older military facilities and shipyards, encountered asbestos during their military service. Decades later, many of them now face serious health concerns like lung cancer, mesothelioma, and asbestosis due to this exposure.

To make their lives easier, there are several legal options available for veterans seeking justice and compensation for their suffering. These include filing VA claims, accessing trust funds, and pursuing lawsuits against liable parties. Let’s discuss these legal options.

How Do Veterans Get Exposed to Asbestos?

Veterans were commonly exposed to asbestos during their military service because of its widespread use in ships, aircraft, buildings, and vehicles between 1930 and 1970. Asbestos was preferred due to its durability and resistance to heat. As a result, it was ideal for the following use cases:

  • Insulation
  • Gaskets
  • Brakes
  • Pipe coverings
  • Fireproof materials

Unfortunately, asbestos’s microscopic fibers become airborne when disturbed and can be easily inhaled or ingested. This happened mostly during maintenance, repair, or demolition of structures containing the substance.

Navy veterans faced the highest exposure risks since ships were heavily insulated with asbestos in the boiler rooms, sleeping quarters, and engine rooms. Air Force, Marine Corps, and Army personnel were also exposed in barracks, construction zones, and aircraft.

Signs of asbestos exposure often take decades to appear, and many veterans do not notice symptoms until long after their service. Conditions like mesothelioma and asbestosis can result from prolonged or repeated exposure.

Since the military heavily depended on asbestos at one point, veterans make up a significant percentage of asbestos-related illness cases. Understanding how exposure happens helps to ensure that victims get the support they need.

Legal Options for Veterans After Asbestos Exposure

Veterans with asbestos-related illnesses may be able to secure health care, compensation, or other benefits if they suffered exposure during their military service. Fortunately, there are several legal options available to victims.

Asbestos Lawsuits

Asbestos lawsuits offer veterans an opportunity to seek compensation if they were exposed to the material during their service years. Many individuals developed mesothelioma and other related illnesses due to unsafe conditions. These lawsuits target manufacturers of asbestos-containing products and not the military. If you live in the state, working with an experienced Mesothelioma Attorney Nevada ensures you get fair compensation.

Asbestos Trust Funds

Bankrupt asbestos manufacturers created asbestos trust funds to compensate victims of exposure, including veterans. These funds allow eligible individuals to file claims without going to court. Veterans who have been diagnosed with asbestos-related illnesses may qualify for significant payouts, depending on their exposure history and condition. Besides lawsuits, filing this claim is a valid legal option.

VA Claims

Claims with the Department of Veterans Affairs can offer individuals financial and medical support for asbestos-related illnesses from their military service. By filing a claim with the VA, eligible veterans can receive disability compensation, healthcare, and survivor benefits.

However, it is necessary to prove a direct link between asbestos exposure during service and the diagnosed condition. For affected veterans seeking support and healthcare, VA claims are an important legal option.

Endnote

Many veterans, especially those who served in the middle of the twentieth century, have developed illnesses due to asbestos exposure. Fortunately, they can legally secure compensation, support, and benefits from lawsuits, trust funds, and VA claims.
